Company: Car Connector Limited, a company registered in England and Wales with company number 16714778  (“we”, “us”, “our”).

These Terms and Conditions govern your use of our remote vehicle diagnostics software and related services (“the Service”). By installing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not install or use the Service.

1. Nature of the Service

1.1 The Service enables a secure remote connection between two parties, facilitating the use of third-party workshop tools and software as though they were connected directly to a vehicle.

1.2 The Service does not itself perform vehicle diagnostics. We are not responsible for the outcomes of any third-party tools, software, or procedures used via the Service.

1.3 You must not use the Service for ECU flashing or reprogramming. We expressly disclaim all responsibility for damages resulting from such prohibited use..

2. Liability Disclaimer

2.1 The Service is provided “as is” and “as available”.

2.2 We make no guarantee that every session will result in a successful or uninterrupted connection, as outcomes depend on environmental conditions, user hardware, network performance and software configurations.

2.3 To the fullest extent permitted by law, we shall not be liable for:

  • Any damage to vehicles, equipment, software, or data;

  • Any loss arising from use or misuse of the Service;

  • Any indirect, consequential, or incidental losses.

2.4 Your use of the Service is entirely at your own risk.

2.5 To the maximum extent permitted by law, our total aggregate liability for any claims arising out of or in connection with the Service shall not exceed the total subscription fees paid by you to us in the 12 months preceding the claim.

2.6 We shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, loss of business, or loss of data, whether in contract, tort, or otherwise.

2.7 The Service is provided without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

2.8 We shall not be responsible for any failure or delay in performing our obligations under these Terms if such failure or delay results from events beyond our reasonable control, including but not limited to acts of God, natural disasters, power failures, internet or telecom outages, strikes, labour disputes, cyberattacks, government actions, or other events beyond our reasonable control.

2.9 You agree to indemnify and hold harmless Car Connector, its directors, employees, and affiliates against any claims, liabilities, damages, or expenses arising from your use or misuse of the Service, including any prohibited activities.

2.10 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

2.11 By using this service you agree to waive your right to jury trial and class action lawsuits.

2.12 Disputes shall be resolved through binding arbitration.

3. Subscriptions and Payments

3.1 Access to the Service is provided by subscription, which may be hourly, daily, weekly, monthly, or yearly. 

3.2 Monthly and yearly subscriptions renew automatically unless cancelled by you prior to the renewal date.

3.3 Subscriptions may be cancelled at any time. However, no refunds will be issued for unused time. You may continue using the Service until the end of your current billing period.

3.4 Payments are processed by Stripe. We do not handle or store your payment card details.

4. Data Protection

4.1 We comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

4.2 We only collect and retain the personal data necessary to operate the Service and to meet our legal obligations.

4.3 Your data is stored securely and will not be shared with third parties except where required by law or essential for providing the Service (e.g. payment processing by Stripe).

5. Support and Service Levels

5.1 We aim to provide timely and effective support for all users.

5.2 Our Service Level Agreement (SLA) for support requests is a maximum initial response time of 5 business days.

5.3 Support is provided via Telegram and you will be provded with a link when signing up.

6. User Responsibilities

6.1 You must ensure that your use of the Service complies with all applicable laws and regulations.

6.2 You are responsible for your own internet connection, hardware, and software environment.

6.3 You must not attempt to reverse-engineer, copy, or misuse the Service.

6.4 You are responsible for ensuring your use of the Service complies with all applicable local laws and regulations in your jurisdiction.

7. Termination

7.1 We reserve the right to suspend or terminate your access to the Service if you breach these Terms.

7.2 Termination of your subscription does not affect any legal rights or obligations that have already arisen.

8. Governing Law

8.1 These Terms shall be governed by and construed in accordance with the laws of England and Wales.

8.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

9. Changes to These Terms

9.1 We may update these Terms from time to time.

9.2 Changes will be posted on our website and/or notified to you in the software. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
